1. Our role
Vardair Aviation AS acts as an air charter broker. We arrange flights as agent for the client with licensed air operators; we are not an air carrier and do not operate aircraft. The contract of carriage is between the client and the operating air carrier, whose conditions of carriage apply to the flight.
2. Quotations
Quotations are based on aircraft availability at the time of issue and are not binding until confirmed in writing by both parties. Availability in business aviation changes hourly; a quotation lapses if not accepted within the period stated on it.
3. Prices
Prices are quoted all-inclusive of flight time, positioning, crew costs, standard landing and handling, standard catering and applicable taxes, unless stated otherwise on the quotation. De-icing, extended ground waiting caused by the client, non-standard catering, ground transport and additional flight time requested after departure are charged at cost and, where foreseeable, capped and stated at quotation.
4. Payment
Full payment is normally required before departure. Where credit terms are agreed in writing, invoices fall due 14 days from issue. We reserve the right to withhold release of the flight where payment has not cleared.
5. Cancellation
Cancellation charges are set by the operating carrier and are stated on your confirmation before you commit. They typically escalate as the departure approaches and may reach the full charter price close to departure. We pass these through without markup.
6. Operational control
The pilot in command holds final authority over the conduct of the flight. Routing, payload, fuel and the decision to depart, divert or delay rest with the operator and its crew on safety grounds, and neither we nor the client may override them.
7. Delay and disruption
Weather, air traffic restrictions, technical issues and airport conditions can delay or prevent a flight. We will use reasonable endeavours to arrange an alternative, but we are not liable for consequential losses arising from disruption outside our control.
8. Passenger information
The client is responsible for providing accurate passenger details, valid travel documents and any advance passenger information required. Costs arising from incorrect or missing documentation are the client's.
9. Liability
Our liability is limited to the brokerage services we provide. Claims relating to carriage lie against the operating air carrier under its conditions of carriage and the applicable international conventions. Nothing in these terms limits liability that cannot be limited by law.
10. Complaints and governing law
